We are BookNote, a sole proprietorship (eenmanszaak) operated by Maciej Daszkiewicz, registered in the Netherlands at Binckhorstlaan 313A, The Hague, South Holland 2516BC, with Chamber of Commerce (KVK) number 42004864 and VAT ID NL005427564B33 ("Company," "we," "us," "our").

We operate the mobile application BookNote (the "App"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

BookNote is a personal reading companion app that helps users take meaningful notes on the books they read. It allows users to save insights, track reading progress, organize their notes by book, and reflect on what they’ve learned. Notes are stored securely on-device and synced through iCloud if enabled.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and BookNote, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms.

If you do not agree with all of these Legal Terms, then you are expressly prohibited from using the Services and you must discontinue use immediately.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are incorporated herein by reference. We reserve the right to make changes to these Legal Terms at any time. The "Last updated" date will always indicate the latest revision.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.

We recommend that you print a copy of these Legal Terms for your records.

1. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Users accessing the Services from other locations do so on their own initiative and are responsible for compliance with local laws.

The Services are not designed for compliance with industry-specific regulations (HIPAA, FISMA, etc.). If your use is subject to such laws, you may not use the Services. You may not use the Services in a way that violates the Gramm-Leach-Bliley Act (GLBA).

2. Intellectual Property Rights

Our Intellectual Property

We own or license all intellectual property rights in the Services, including source code, databases, functionality, designs, audio, video, text, photographs, graphics ("Content"), as well as trademarks and logos ("Marks").

The Content and Marks are protected by copyright, trademark, and other intellectual property laws.

You may access and use the Services, and download or print a copy of accessible Content, solely for personal, non-commercial use.

Except as expressly permitted, you may not copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, or otherwise exploit any Content or Marks without our prior written permission.

Any breach of these rights will immediately terminate your right to use the Services.

Your Submissions

By sending us any feedback, suggestion, or idea ("Submissions"), you assign all intellectual property rights in such Submission to us. We may use it for any lawful purpose without acknowledgment or compensation.

You are responsible for your Submissions and agree that they:

• Do not violate applicable law or third-party rights.
• Are original to you or properly licensed.
• Do not contain confidential information.

3. User Representations

By using the Services, you represent and warrant that:

1. You have legal capacity and agree to these Legal Terms.
2. You are not a minor in your jurisdiction.
3. You will not access the Services by automated/non-human means (e.g., bot, script).
4. You will not use the Services for illegal or unauthorized purposes.
5. Your use will comply with all applicable laws and regulations.

If you provide false or incomplete information, we may suspend or terminate your account.

4. Purchases and Payment

We accept payment through:

You agree to provide accurate and up-to-date purchase and account information. Sales tax may be applied as required. Prices may change at any time.

We may refuse or limit orders in our discretion, including limiting purchases per person, household, or payment method.

5. Subscriptions

Billing and Renewal

Subscriptions automatically renew unless canceled. Charges will recur according to your chosen billing cycle until you cancel.

Cancellation

You can cancel via your Apple ID settings. Cancellation takes effect at the end of the paid term.

Fee Changes

We may update subscription fees and will notify you as required by law.

6. Software

We may include software with the Services. If a license (EULA) is provided, its terms apply. Otherwise, we grant a limited, revocable, non-transferable license for personal use.

All software is provided “AS IS”, without warranties of any kind.

7. Prohibited Activities

You agree not to:

• Extract data systematically.
• Mislead or defraud us or users.
• Circumvent or disable security features.
• Upload harmful or malicious material.
• Harass, threaten, or impersonate others.
• Reverse-engineer or tamper with the app.
• Use automated systems (bots, scrapers, etc.).
• Use the Services for unauthorized commercial purposes.

8. User Generated Contributions

The Services do not permit users to post or submit content.

9. Contribution License

By providing feedback or suggestions, you grant us the right to use and share it without compensation.

10. Mobile Application License

Use License

We grant a revocable, limited license to install and use the App on your device, subject to these Terms.

You may not reverse-engineer, modify, resell, or use the App for unauthorized purposes.

Apple and Android Devices

Additional conditions apply when accessing via the App Store or Google Play, including compliance with their terms of service.

11. Third-Party Websites and Content

The Services may include links to third-party sites or content. We do not control or endorse such sites and are not responsible for their content, policies, or products.

12. Services Management

We may monitor, restrict, remove, or disable access to content or users at our discretion, to protect the Services and our rights.

13. Privacy Policy

Our Privacy Policy is available within the app settings. By using the Services, you agree to its terms.

14. Term and Termination

We may suspend or terminate your access to the Services at any time, without notice, for violation of these Legal Terms or applicable laws.

15. Modifications and Interruptions

We may change or discontinue the Services at any time. We are not liable for downtime, errors, or interruptions.

16. Governing Law

These Legal Terms are governed by the laws of the Netherlands. Consumers in the EU retain protections provided by their local laws.

17. Dispute Resolution

Informal Negotiations

Parties agree to attempt informal resolution for 30 days before arbitration.

Binding Arbitration

Disputes will be settled under the European Court of Arbitration, seat in Amsterdam, Netherlands, in English.

Restrictions

No class actions or representative claims permitted.

Exceptions

Claims relating to intellectual property rights, theft, privacy, or injunctive relief are excluded.

18. Corrections

We may correct errors, inaccuracies, or omissions in the Services at any time without notice.

19. Disclaimer

The Services are provided “AS IS” and “AS AVAILABLE”. We disclaim all warranties to the maximum extent permitted by law.

20. Limitations of Liability

We are not liable for indirect, incidental, or consequential damages. Liability is limited to the lesser of amounts paid by you in the last 6 months or $100.

21. Indemnification

You agree to indemnify and hold us harmless from claims, damages, or losses arising from your use of the Services or violation of these Terms.

22. User Data

We may maintain data you transmit for performance of the Services. We are not liable for any loss or corruption of such data.

23. Electronic Communications, Transactions, and Signatures

You consent to electronic communications and signatures. Agreements and notices delivered electronically satisfy legal requirements.

24. California Users and Residents

Unresolved complaints may be submitted to the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, Tel: (800) 952-5210.

25. Miscellaneous

These Legal Terms are the entire agreement between you and us. If any part is unlawful or unenforceable, the remainder will remain in effect.
